Terms of use and license
The agreement, in plain words.
Short version: you own what you record and what the app makes from it; recording other people lawfully is on you; Pro is billed by Apple through the App Store and renews until you cancel it there; refunds for App Store purchases go through Apple. This is a custom license that takes the place of Apple's standard one.
Who you are agreeing with
Chase Memories is made by Chase Color, Inc., a Delaware corporation. Post: 350 E 400 S, STE 54472, Salt Lake City, UT 84111, United States. Email: support@chasememories.app. This agreement is between you and Chase Color, Inc., not Apple. Apple is not responsible for the app or its content.
Who may use Chase Memories
You must be at least 13, or older where your country sets a higher minimum age. Chase Memories is not directed to children under 13.
Recording other people
You are responsible for recording lawfully. In many places everyone in a conversation must agree to being recorded, and in some places one party's agreement is enough; the rule that applies is the one where you and the other people are. The app shows on screen, and on the lock screen, that it is recording. Telling the people you are with, and getting their agreement where it is needed, is on you. Nothing in the app suggests to other people that they are not being recorded, and nothing here should be read that way.
Your content
You own what you put into Chase Memories and what it makes for you. When backup is on, you give us permission to store and transmit the encrypted form of your content in order to keep your devices the same, which is the only thing we can do with it. That permission does not let us read it, train anything on it, or hand it to anyone: we hold no key.
The door is always open: you can export every recording, picture and transcript as ordinary files at any time, free, without an account.
The license
We give you a personal, non-transferable license to use Chase Memories on Apple devices that you own or control, as Apple's usage rules allow. You may not copy, sell, rent, lend or distribute the app, or work around the protections in it. Chase Memories, its name and its design are ours; your content is yours.
Free, Pro, prices and tax
Chase Memories Free costs nothing and includes two hours of transcription a month; recordings over the cap are saved and transcribed when the allowance returns or when you upgrade. Chase Memories Pro is US$4.99 a month or US$29.99 a year and adds unlimited transcription and encrypted backup and sync, with fair use of about 100 GB of backup. Privacy, export and the app lock are never behind Pro.
Pro is sold on iPhone as an auto-renewing subscription through the App Store. Apple runs the purchase and handles the tax, and the subscription renews until you cancel it under Subscriptions in your Apple Account settings. If Pro ends, your backup is kept for 90 days and then removed; your memories on the phone are untouched.
Refunds
Pro is billed by Apple. Apple handles refund requests for purchases made inside the app, under Apple's own terms, and we cannot refund an Apple purchase on Apple's behalf. Today every Pro subscription runs through the App Store; if we ever charge you directly, outside the App Store, that charge can be refunded within 14 days of the charge and is not refundable after 14 days.
Ending the agreement
You may end your account at any time, from inside the app under Settings, Account, and it takes effect at once: the backup and the account's records are removed. We may end an account for a breach of these terms, for abuse, or for illegal use, or at our discretion on reasonable notice. Ending the account does not touch the memories on your phone.
Support and maintenance
We provide support for the app at the address above. Apple has no obligation to furnish any maintenance or support for it.
Warranty
Chase Memories is provided "as is", with no warranty. If the app fails to conform to any warranty the law gives you, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claim, loss, liability or expense is our responsibility.
Claims and legal compliance
We, not Apple, are responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar laws. If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim. You represent that you are not in a country under a United States government embargo or designated a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
Limitation of liability
Our liability is limited to the greater of US$50 or the fees paid in the 12 months before the event giving rise to the claim.
Apple and third parties
Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple has the right, and is deemed to have accepted the right, to enforce it against you. You must comply with any third-party terms that apply when you use the app, such as your carrier's data agreement.
Governing law and where disputes go
These terms are governed by Delaware law, and disputes are resolved in Delaware courts rather than by arbitration.
